1. When is a permit needed when I do work or have work done at my property?

More than likely a permit is required. You will also need to have the permit before work begins. If you are not sure about whether or not you need a permit, please call the Permitting Office at 713-662-8230 or 713-662-8231. 2. How much do permits cost?

They vary. Please verify the cost of each permit with the Permit Department. They can be reached at 713-662-8230 or 713-662-8231. Additionally, there is a schedule of fees on the Community Development Department page on the City website under the heading "Fee Schedule."

3. Do I need a permit to repair or replace a fence?

Yes. Homeowners may get a "Homeowners Building Permit" only if your home is listed under Harris County Appraisal District as your homestead to repair a roof or remoded the house.

Yes, they must have a minimum of $300,000 of general libability to be able to do any type of work within the city.

No. We take checks and or cash.

13. Which building and trade codes does the City use?

2006 Editions of the International Building Code, International Residential Code, International Mechanical Code, International Plumbing Code, International Gas Code, 2009 International Energy Conservation Code, and the 2005 National Electrical Code.

14. What is an elevation certificate or a FEMA certificate and where do I get one?

It is a Federal Form used to certify the finished floor elevation of a house or garage. If one exists in the City records, you may obtain a copy from us. If one is not available, you can contract with a Texas Registered surveyor and they will provide one for you.

15. How can I find out what flood zone my property is located in and what does the designation mean?

The flood plain maps are located on the City website at www.ci.bellaire.tx.us. The maps are located under the heading "maps." From there, you will be directed to the City GIS map. On the "layers" tab highlight "base flood elevation," "TSARP Contours," and search by your address. The floodplain will be highlighted in pink. If you require further assistance, please contact the Building Official or the Harris County Flood Control Office at 713-684-4000. The flood plain maps are also available through the Harris County Flood Control's website at www.hcfcd.org.

16. My house was damaged and I would like to remodel. Can I do that if my HCAD appraisal records show my house is worth $100.00?

When a house is in the 100-year flood plain, you are not allowed to spend more than 50% of the house value. You may obtain a private appraisal of your house and the City will honor that appraisal amount when considering your permit application.

17. Is Bellaire zoned?

18. What does it mean to be zoned?

Zoning is the way governents control the physical develoment of land and the kinds of uses for which each individual property may be used.

Zoning laws typically specify the areas in which residential, industrial, recreational or commercial activities take place. For example, an R-1 residential zone allows only single-family detached homes to be built in its district. On the other hand, a CCD-1 zone would be an area that permits only certain commercial or industrial uses in a City Center District. An RM zone would allow a mix of housing and business in another part of the City.

19. What is a plat?

A document, which may include a graphic description of a tract of land by metes and bounds, giving dimensions of all easements, setbacks, subdivision names, streets, alleys, squares, parks, other public areas, and giving dimensions of all lots or tracts contained therein, pursuant to the Texas Local Governement Code, Chapter 212, Municipal Regulation of Subdivisions and Property Development and/or the City of Bellaire Code of Ordinances.

A plat is a survey that contains all of the above information on a particulat piece of land or subdivision.

20. What is an amended plat?

A plat on which a lot line separating two individual lots has been removed through a legal process, combining the two original lots into one larger lot. The address of the lot that was taken in to the other will be stricken from the legal records once the amended plat has been filed and recorded by the County Clerk's Office.

21. What is a replat?

A proposed modification of an existing plat, typically increasing the number of lots, pursuant to the Texas Local Government Code, Chapter 212, Municipal Regulations of Subdivisions and Property Development and/or the City of Bellaire Code of Ordinances. A replat may not amend or remove existing covenants or Deed Restrictions.

22. How do I find out if I am in the Flood Plain?

The new maps created by the Tropical Strom Allison Recovery Project (TSARP) are now the FEMA effective Flood Insurance Rate Maps and are being used to determine insurance requirements and rates. 23. When do I need a Certificate of Occupancy?

You need a certificate of occupancy anytime an existing home is either for sale or for rent, or the seller/landlord must come to the community development office and apply for a certificate of occupancy. Commercial properites also require a Certificate of Occupancy

24. Under what circumstances would I want or need to amend my plat?

1. When you want to build a structure on two separate but adjacent lots
2. When you buy the lot next door and want to combine it with your existing property or

You will need to visit the Harris County Clerk's Office. You can check their website at www.ci.cclerk.netx.net for information on locations, phone numbers, and hours of operation. You will need to take the legal description of your property with you and that can be obtained by accessing the HCAD website at www.hcad.org.

28. My neighbor has a backyard full of old car parts and tires. Help!

31. I own a lot in a residential section of Bellaire and I own a small business that needs an office. May I use the house and/or property as an office/business only?

No. The City's Zoning Regulations prevent a building located in a residential district from being used strictly as a business or an office. A room in the home or garage may be used as an office as long as the owner of the business is living in the house. Under all circumstances, the zoning regulations are meant to preserve the integrity of the residential neighborhood.

32. I just bought a new boat. Can I store it in the front of my house or in my driveway?

You may not store it in front of the house, even in the driveway, unless you can store it behind the front building line.

33. Does the City have a Tree Ordinance?

No. Such types of signs are prohibiited within the Bellaire City limits.

1. Can I take Defensive Driving to have my ticket dismissed?

It must be a moving violation and you must be elibible to take the defensive driving class.

2. How do I know if I am eligible to take defensive driving?

If none of the following pertain to you, you will be eligible to take Defensive Driving:

Person's holding a commercial driver's license at time of offense; non Texas driver's license; speeding 25 mph or more over the posted speed limit; committing a traffic offense in a construction zone when workers are present; passing a school bus loading or unloading children; if you have taken the class for another ticket dismissal within a year or you are currently taking the class for another ticket dismissal.

3. How long do I have to take the defensive driving class?

You have 90 days from the date you come in to request the Driving Safety Course (DSC) and sign the affidavit.

4. What are the requirements to take a defensive driving class?

1. Come to the Court Clerk window on
or before your court date to request the Driving Safety Course or you may appear on your court date before the judge.
2. Plead guilty or nolo contendere(No Contest) and waive a jury trial;
3. Pay court costs in the amount of $107.00 unless the offense occurred in a school-crossing zone, then pay court costs in the amount of $132.00.

5. Can I show my proof of insurance at the clerk's window?

NO, if you have renewed your stickers you will have to appear in court on your court date before the judge and present him with proof that your stickers have been renewed.

7. How do I reset my court date?

All court date resets must be done in person.

8. Can I reset my court date the same day I have court?

NO, all resets must be done prior to the court date.

9. If I have a trial date can I reset my court date?

To reset a trial date you must post a cash bond in the amount of the citation.

10. Can I reset my court date over the phone?

NO, all court dates must be reset in person, if you are attending court for the first time and have an arraignment date, the reset will be for one week and one time only. If you need more time, you must attend court on the given court date and talk to the judge about a later date.

11. When do I have to pay the court costs?

When you come in to request the Driving Safety Course (DSC), you must pay the court costs at that time, if you are unable to pay the DSC you will have to appear in court before the judge.

12. Can I be placed on a payment plan?

In order to be placed on a payment plan, you must appear in court on your court date before the judge.

13. Can I be placed on a payment plan on a warrant?

That will be up to the judge. They look at how long the sticker was expired and how long it took you to get them renewed, if the charge is not dismissed with a fee, the judge might reduce the fine.

1. What are the requirements for starting new water, sewer, garbage and recycling service?

The Owner/Tenant must know who they buying/renting the property from. The applicant must go to the second floor of the City Hall Building at 7008 S. Rice Ave and fill out the contract in person. There is a deposit and service fee required at time of service request. The current Deposits are Owner $50.00, Tenant $100.00, and Commercial $100.00. There is also a $35 Service Fee at this time, the owner's deposit is refundable after 12 consecutive of good pay history. Tenants & Commercial deposits are released upon termination of account.

2. When is my bill due?

No, the City does not make any leak adjustments on water bills. The Owner/Tenant/Landlord is resposible for any water that has passed through and registerd on the meter. Also, the City of Bellaire does not make any adjustments on any type of pool filling.

The only place you can purchase garbage bags is at the City Hall Building on the second floor located at 7008 S.Rice Ave between the hours of 830-4pm, Monday - Friday. Each roll is $5.95, including taxes.

Fire Department - Business Questions

1. My building has a sprinkler system. Are there things I should do to maintain the system?

If you own the building, you are required to see that the system is tested annually by a reputable contracted agency and the documentation of this test should be kept on file for the fire department to view in accordance with International Fire Code chapter 9. If there is a system in your building it must be in operational condition at all times. If you are a tenant or owner-occupant, there are other things you can do to be sure your system is ready in case it is needed. Never paint a sprinkler head. Each sprinkler head is designed to cover a certain amount of area in your building so before you build walls or large shelving units or stack storage to the ceiling, check with your fire inspector to be sure what you do won’t prevent the sprinkler head from doing it’s job. Also, never hang anything from a sprinkler head.

2. On TV, when a sprinkler head begins to spray water, they all do. Is this how my sprinklers will work?

No, most sprinkler systems with a few exceptions, (and those are found only in heavy industry situations), are designed to activate only where the fire is. The heat from the fire activates the sprinkler head closest too it. If the fire is large enough it may activate more than one head in the area but it will not activate every head on an entire floor.

3. The Fire Department has been inspecting my building for many years and has never mentioned a violation in the past. Why are they indicating a violation this time?

Fire codes are updated regularly. Some of the things that cause changes in these codes may be a newer type of construction, a new construction method or an event that occurred where people were injured. Whatever the reason, when the codes are updated, it is necessary to inspect your facility under the most current code. This may result in a change from the previous year in your inspection

5. My building has a fire alarm system. Are there things I should do to maintain the system?

6. Our alarm system keeps having false alarms. The alarm goes off but no fire is found. Can’t we do something about this?

Fire alarms seldom malfunction. Usually, if they are sounding, there is a reason. Sensing devices may need cleaning or replacement. Other reasons causing alarm activation may be as simple as a bag of popcorn that overcooked in a microwave, a co-worker smoking in an area where they shouldn’t be, or dust from re-modeling. In all of cases, even though big flames were not shooting from the building and hoses were not needed to put the fire out, the system was doing its job of alerting everyone in the building to a possible danger of a fire. If your system activates, immediately leave the building and do not re-enter until the proper authority investigated the alarm and gives the all clear to enter the building. Take every fire alarm seriously, follow your established evacuation plan, leave the building until someone of authority (building maintenance, security, the fire department, etc.) tell you it is safe to return.

7. Is there a requirement for a Fire Drill in my building?

Yes, the International Fire Code requires an annual fire drill. Bellaire Fire Department has adopted a “down and out” policy. This differs from the City of Houston where tenants only have to go to the stairwell. We believe that the drill must simulate a real scenario to be useful.

9. If during an inspection a violation is found how long do I have to fix it?

For a routine (non-life threatening) violation we usually grant 10 business days for correction. If a life threatening violation is found we require it to be corrected immediately. If a violation cannot be corrected in the amount of time given then we will work with the owner/occupant to ensure compliance as quickly as possible.

No, there are multiple organizations that sell detectors for the same amount or less than Bellaire Fire Department can. We will help install the detectors for Senior Citizens and provide on-site information on the proper place to install for all others.

4. Does the City Of Bellaire allow open burning?

No, city ordinance does not allow any type of open burning. Flames used to smoke or Bar-b-que are acceptable.

5. Does the Bellaire Fire Department fill swimming pools?

No, this is the responsibility of the homeowner or pool company

6. Where should a Fire Extinguisher be placed in the home?

Having a fire extinguisher in the home is a good idea, but not mandated by the Bellaire Fire Department. If you have an extinguisher, it should be placed where it is easily accessible. The kitchen and garage are good sites for an extinguisher. However, do not place an extinguisher over the stove or buried in storage in the garage, but rather hang it on the wall no less than 4 inches or greater than five feet from the ground.

7. What is carbon monoxide? Could I have this in my house and do I need a carbon monoxide detector?

There are many things that give off carbon monoxide. They include gas appliances such as furnaces, water heaters and stoves. Fuel burning space heaters and wood burning fireplaces can give off carbon monoxide. Even warming up your car or barbecuing in your garage can fill your house with carbon monoxide. The problem is that it is an odorless, colorless gas so until you begin to see symptoms, you don know it’s there. People experiencing carbon monoxide poisoning feel like they have a flue that came on suddenly. This also affects small pets and even plants. Carbon monoxide detectors will sense excessive levels of the gas early and warn you to leave.

If the material is put in the bookdrop before the library is opened the next day, it is considered to have been returned on the previous day. In other words, if your movie is due on Tuesday and you put it in the bookdrop before 9:00 am on Wednesday, it is not considered overdue.

8. Are fines charged on the weekend and holidays?

Yes, fines are charged on Sundays and all holidays. You can always return the material in the bookdrop to stop the fine.

If the material is found within 90 days from date of payment, then the cost of the material will be refunded. Fines and processing fees are not refunded.

The Mosquito Control Program uses environmentally friendly fog to control mosquito populations in Bellaire. Spraying in Bellaire beings when Harris County Mosquito Control begins to spray. Typically this begins in May and lasts until October. The City may spray earlier or later to reduce mosquito populations.

4. What are the collection requirements for Residential Solid Waste?

Per the City of Bellaire Code of Ordinances, Sec. 16-2. Collection requirements:

Garbage shall be placed in plastic bags, having a minimum thickness of 1.5 mil and a capacity of not less than 20 gallons each and which will not leak when handled. Such bags shall be tightly closed by cord, wire, or rubber band, in such manner as to prevent leakage of contents. Paper bags may be used under the same terms and conditions as plastic bags, provided such paper bags consist of at least two (2) sheets of 50 pound wet strength extensible paper.

a) No containers shall be used except for plastic bags and the approved paper bags stated above.

b) Garbage shall be placed behind the curb at no more of a distance than three (3) feet behind the curb.

c) No more than six (6) garbage bags will be collected per home.

d) Each bag shall contain no more than twenty-five (25) pounds of garbage.

e) Garbage must be set out for collection by 7 AM. Garbage collection will commence at 7 AM.

f) No garbage shall be set out for collection before 6 PM the day before the collection date.

g) No garbage shall be set out for collection on City holidays.

h) All glass being disposed of as garbage such as, but not limited to, windowpanes, sheet glass and broken glass shall be wrapped in cardboard and taped before setting out for collection.

i) All sharp objects or objects with sharp, cutting edges being disposed of as garbage such as, but not limited to, broken plastic and metal fragments shall be wrapped in cardboard and taped before setting out for collection.

j) Needles shall be put in a bottle or other container secured with a lid before setting out for collection.

k) No automotive oil or automotive fluids of any type such as, but not limited to, motor oil, transmission fluid, brake fluid, power steering fluid and windshield wiper fluid shall be deposited nor accepted in the garbage for collection.

l) No swimming pool cleaning chemicals or chemicals of any type such as, but not limited to, chlorine and turpentine shall be deposited nor accepted in the garbage for collection.

m) Oil-based paint shall not be deposited nor accepted in the garbage for collection. Latex paint may be accepted for collection only if it has been thoroughly dried and hardened.

n) No cardboard or aluminum cans shall be accepted in the trash – cardboard and aluminum cans shall be placed with recyclables for collection.

o) The homeowner may also purchase a sticker to be placed on the garbage bags in excess of the allowed six (6) bags for collection.

o The sticker may be purchased at City Hall, located at 7008 S. Rice Ave., upstairs in the Utility Billing department.

o The price for the stickers shall be set by the City Manager.

5. What are the collection requirements for Tree Limbs and Brush?

Per the City of Bellaire Code of Ordinances, Sec. 16-7. Garbage generated or collected by commercial tree trimming, lawn maintenance, gardening or landscaping services, handymen or any others not considered the occupant.

It shall be unlawful for any commercial tree trimming, lawn maintenance, gardening or landscaping services, handymen or any others not considered the occupant who shall be employed within the city limits of the city to prune or trim and tree, hedge, or bush, to fail to haul away grass, tree, hedge, bush and landscape trimmings from the city limits of the city to a point outside the city limits of the city.

Per the City of Bellaire Code of Ordinances, Sec. 16-8. Garbage consisting of tree, hedge, and bush trimmings cut by the owner.

All limbs, brush and tree sections 3” in diameter or smaller and cut personally by the owner shall be cut in four (4) foot lengths and tied in a bundle not greater than two (2) feet in diameter and placed with household garbage for collection. The limit shall be three (3) bundles per household per collection day.

All limbs, brush and tree sections greater than 3” in diameter and cut personally by the owner shall not exceed 8” in diameter and shall be cut in lengths not to exceed four (4) feet and stacked three (3) feet behind the curb in piles not exceeding four (4) feet in height. The weight limit shall not exceed 200 pound per collection per day.

Limbs and brush cut personally by the owner shall be stacked for collection with no overhead obstructions such as, but not limited to, trees, streetlights and power lines. Vertical clearance shall be 30 feet from the ground.

Brush, limbs and tree sections not collected due to non-compliance with this ordinance shall be removed by the owner within 24 hours of notification at the owner’s expense.

6. What is the maximum amount city will haul per day per premises?

Per the City of Bellaire Code of Ordinances, Sec. 16-4. Maximum amount city will haul per day per premises:

Not more than 150 pounds of garbage and 200 pounds of brush shall be hauled away in any one day from any one residential establishment by the garbage collectors of the city. Any garbage at any such establishment in excess of 150 pounds shall be hauled away to a proper place of disposal outside the City of Bellaire, at the owner’s expense, by the occupant of the property where it is gathered, or by the person or persons gathering it, within 24 hours after it is gathered.

Should a City holiday fall on your scheduled collection day, service will be provided on the next regular collection day.

City holidays: New Year's Day, Martin Luther King, Jr Day, Memorial Day, Fourth of July, Labor Day, Veterans Day, Thanksgiving (Thursday and Friday), Christmas Eve and Christmas Day.

If a holiday falls on a Saturday, City services are closed on the Friday before. If a holiday falls on a Sunday, City services are closed on the following Monday.

Please help maintain the appearance of the City by not putting garbage and trash out earlier than 6:00 p.m. the day before your regular collection day. The City's collection services begin at 8:00 a.m.
